As an attorney (a trial attorney at that), I'm disgusted by that kind of behavior. This is not why we have courts. I must say, I'm a fan of "extra-judicial" remedies. I believe, after reading this, that the McCarthy/Derrik family should be shunned. Good ole fashioned ostracism.
When Miss Derrik is at school, the other students should refuse to speak/play with her. Ms. McCarthy's co-workers and friends should take a similar tack. Why should the child be subjected to the treatment? Because hopefully, after seeing what her overly-litigious behavior has done to her daughter, Ms. McCarthy will come to her senses (read: realize what a terrible person she is for putting her daughter through this crap over a gizmo).
This is a frivolous lawsuit, plain and simple, and any attorney prosecuting it encrappens the profession.
